Client Wins Repo Deficiency Lawsuit Filed by Ally Financial

» Print This Page

Ally Financial sued our client for a vehicle he had purchased from Orlando Dodge. The vehicle was later repossessed, and sold by Ally Financial at an auction. Ally Financial then sued our client for a deficiency, claiming that it was entitled to the balance due after the auction. This is known as a “repo deficiency lawsuit”.

Initially, our client tried to fight this by himself. However, he soon realized he needed an attorney with significant experience in defending against debt collection lawsuits and especially repo deficiency lawsuits. When he retained Taras Rudnitsky and the Rudnitsky Law Firm, we quickly used our experience with a repo deficiency lawsuit and auto fraud issues to identify and assert numerous defenses to the Ally Financial repo deficiency lawsuit. We took the deposition of Ally Financial, which proved many of our defenses. We then filed a motion with the Court explaining why our client was entitled to win the lawsuit. The Court granted a final judgment in our client’s favor. Not only did our client not have to pay anything to Ally Financial, he actually recovered money from them!
